Welcome to Seekers (“the App”), operated by Bnei Baruch America Inc. (“we,” “us,” or “our”).
By downloading, accessing, registering for, or using Seekers, you agree to these Terms of Use (“Terms”) and our Privacy Policy (collectively, the “Agreement”). If you do not agree, please do not use the App.
1. Eligibility
You must be at least 13 years old to use the App. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have permission from your parent or legal guardian to use the App.
We may use age information provided directly by you, by app stores, or through age-verification services to determine your eligibility to access the App or certain features. If we determine that you do not meet the minimum age requirements, we may restrict, suspend, or terminate your access to the App.
By creating an account or using the App, you represent and warrant that you meet all applicable age requirements and that any information you provide regarding your age is accurate.
2. Description of Service
Seekers provides bite-sized audio doses of authentic ancient wisdom adapted for modern life.
The App is available on iOS and Android devices. Features may include:
- Access to curated audio content
- User-generated content and comments
- Community features, including the ability to report content and block other users
- Personalized recommendations
- Optional membership or subscription features
We reserve the right to modify, suspend, or discontinue any part of the App at any time without notice.
3. Accounts and Registration
To access certain features, you must create an account. You agree to:
- Provide accurate and current information (including name, email, age, age-related eligibility information, and gender where applicable), and maintain such information as accurate and up to date
- Maintain the security of your password
- Notify us immediately of any unauthorized use of your account
You are responsible for all activities that occur under your account.
3A. Age Verification and Age Signals
To comply with applicable laws and platform requirements, Seekers may receive age-related information from app store providers, including Google Play and Apple App Store, and may use age-verification technologies or services.
For example, Google Play may provide age signals indicating whether a user falls within a particular age category. We may use such information to:
- Verify eligibility to use the App
- Determine whether parental consent is required
- Enable, disable, or modify certain features or content
- Comply with legal and regulatory obligations
- Enhance online safety for younger users
Where required by law, access to the App or certain features may be conditioned upon parental consent or successful age verification.
We do not guarantee that age information provided by third parties is error-free and reserve the right to request additional information when necessary to verify eligibility or comply with applicable laws.
4. Subscriptions and Payments
Some features may require payment of fees (e.g., membership or subscription).
- Pricing, billing, and renewal terms will be disclosed before purchase.
- Payments are processed through third-party providers (e.g., Apple App Store, Google Play Store, or other payment processors).
- Your subscription will auto-renew unless canceled at least 24 hours before the renewal date.
Refund Policy: Refunds will be handled in accordance with the policies of the payment processor and applicable law.
5. User Content, Reporting, Blocking, and Moderation
You may be able to submit, upload, share, or comment on content through the App. By doing so, you grant us a worldwide, royalty-free, non-exclusive, transferable license to use, reproduce, modify, and display that content for the purposes of operating, moderating, maintaining, and improving the App.
You are solely responsible for the content you post, and you agree not to:
- Post anything unlawful, harmful, threatening, harassing, abusive, defamatory, obscene, hateful, sexually explicit, or otherwise objectionable
- Infringe on any intellectual property, privacy, publicity, or other rights of others
- Impersonate another person or misrepresent your identity
- Use the App to harass, intimidate, threaten, or abuse another user
- Post spam or otherwise misuse the App's community features
Reporting Content
Users may report comments or other user-generated content they believe is inappropriate, abusive, or otherwise violates these Terms.
Reports may be reviewed by our moderation team. We may take action we consider appropriate based on the circumstances, including removing content, restricting commenting privileges, suspending an account, or terminating an account.
Submitting a report does not necessarily mean that the reported content or user will be removed or restricted. Moderation decisions are made separately based on our review of the relevant content and circumstances.
Blocking Other Users
Users may block other users through the App.
When you block another user, that user's comments and other applicable content will be removed from your view while the block remains active. Blocking another user does not, by itself, suspend that user's account or prevent that user from using the App or posting content for other users.
A blocked user may continue to access and delete their own existing comments through their profile, unless particular content has been removed by us as part of a moderation action.
Blocked users are not notified that they have been blocked by another user.
Blocking a user may also send information concerning the blocked user and relevant content to us for moderation and safety purposes. We may review this information and determine whether further action is appropriate.
Comment and Content Moderation
Blocking by an individual user and moderation by us are separate actions.
We reserve the right, but are not obligated, to review, monitor, restrict, hide, or remove user-generated content that we determine violates these Terms or is otherwise inappropriate for the App.
We may temporarily or permanently restrict a user's ability to post comments or other user-generated content if we determine that the user has violated these Terms, engaged in abusive or harmful behavior, or otherwise misused the App's community features.
A restriction on commenting does not necessarily prevent the affected user from accessing other features of Seekers.
If your commenting privileges are restricted, you may continue to access and delete your own existing comments unless those comments have been removed by us as part of a moderation action.
Where appropriate, users whose commenting privileges have been restricted may contact us at seekersapp@kabuconnect.com for information or to raise concerns regarding the restriction.
We reserve the right to remove any user-generated content or take other moderation action at our discretion, subject to applicable law.
6. Privacy
Our collection and use of personal information is governed by our Privacy Policy.
Information we may collect includes information you provide directly (such as your name, email address, age, and gender) as well as information received from app stores, age-verification providers, or other authorized third parties, including age-related signals or eligibility indicators.
We may use such information to verify eligibility, determine whether parental consent is required, comply with legal obligations, provide age-appropriate experiences, and operate and improve the App.
Information associated with reports, blocked users, and moderation actions may also be processed for the purposes of operating our community features, investigating inappropriate content or behavior, enforcing these Terms, and maintaining the safety and integrity of the App, as further described in our Privacy Policy.
By using the App, you consent to the collection, use, processing, and disclosure of your information as described in our Privacy Policy and these Terms.
7. Data Security & Retention
We take reasonable measures to protect your information, but no method of transmission or storage is 100% secure.
We retain personal data unless you request deletion via the in-app account deletion function or by contacting us at info@kabbalah.info.
8. Termination and Restrictions
You may delete your account at any time within the App or by contacting us.
We may remove content, restrict your ability to post comments or use community features, suspend your account, or terminate your account if you violate these Terms, engage in harmful or abusive activity, or misuse the App or its community features.
Not every violation will result in account termination. Depending on the circumstances, we may take more limited moderation measures, including removal of particular content or temporary or permanent restriction of commenting privileges.
Upon termination, your right to use the App will immediately cease. Certain provisions (such as intellectual property rights, disclaimers, and liability limits) will survive termination.
9. Intellectual Property
All materials in the App — including text, images, audio, video, and code — are owned by or licensed to us and protected under copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
10. Third-Party Services
The App may contain links or integrations with third-party services (e.g., payment processors, analytics providers). We are not responsible for the content, policies, or practices of these third parties.
11. Disclaimer of Warranties
The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be uninterrupted, secure, or error-free.
12. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the App.
13. Indemnification
You agree to indemnify and hold harmless Bnei Baruch America Inc. and its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising from your use of the App or your violation of these Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law principles.
15. Changes to Terms
We may update these Terms from time to time. The updated version will be posted in the App and/or on our website with a revised “Effective Date.” Continued use of the App after changes means you accept the updated Terms.
We may also update these Terms as necessary to comply with changes in applicable laws, regulations, platform requirements, age-verification obligations, or changes to our community and moderation features.
